These Terms of Service ("Agreement") govern your use of the services provided by floobfloob.com, including but not limited to access to the website, applications/API, and any other related services (collectively referred to as the "Services"). By accessing or using the Services, you agree to be bound by this Agreement.

1.0 Acceptance of Terms

By accessing or using these Services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use these Services.

If you choose not to accept, your account(s) will be suspended.

2.0 User Accounts

You will most likely be required to create/sign into an account to access most certain features of these Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If there is any unauthorized use of your account, you can contact an administrator.

2.1 User Account Termination

The administrator(s)/moderator(s) of floobfloob reserve the right to terminate, suspend, or delete user accounts at their discretion, with or without cause, and without prior notice. This includes but is not limited to accounts that violate these Terms of Service, engage in fraudulent activities, misuse the platform (in places such as markets or trading), or pose a threat to the security and integrity of these Services. By using floobfloob.com (or its related services), you acknowledge and agree that these administrator(s)/moderator(s) may take such actions to enforce compliance with these policies and protect the community and resources of the platform.

2.2 User Account Security

I/we take the security of user accounts seriously. Users are responsible for maintaining the confidentiality of their account credentials and are encouraged to use strong, unique passwords. In the event of unauthorized access or suspicious activity, users can notify admins/moderators immediately for prompt action to protect their account and this platform's security.

2.2.1 Loss of Data

Users should be vigilant against potential scams or phishing attempts. FloobFloob is not liable for data loss due to unauthorized access, fraudulent activities, or errors, but will take action to investigate and mitigate any such incidents to safeguard users' information and maintain a secure platform.

3.0 Content

3.0.1 Content Ownership

You retain ownership of any content you submit, post, or display on or through these Services ("User Content"). By submitting User Content, you grant floobfloob a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with these Services.

3.0.2 Content Policy

b. You agree not to post or transmit any User Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or otherwise objectionable.

3.1 User Data

The administrator(s) of floobfloob reserve the right to access or modify your account data without having cause or notice, such as account information, virtual currencies / items, etc., but do not have the right to read or modify personal information such as your email or password.

3.2 Personal Data Encryption

Your sensitive/personal information is securely encrypted in the floobfloob database (4.0) and can only be read by secure floobfloob API methods. FloobFloobb Administrator(s) do not have the right to use these methods, and only the site can/is permitted to (securely) view your info.

4.0 FloobFloob Database (ffb1834)

Most data related to these Services is stored on a Firebase realtime-database. This is not entirely secure, although personal/private information is tried to be kept at as high security as possible. However, users should understand that no system is entirely immune to breaches, and by using this platform, they acknowledge and accept the inherent risks associated with data storage and transmission over the internet.

5.0 Intellectual Property

All content included on these Services, such as text, graphics/fonts, logos, images, audio clips, video, data, software, extensions, and other materials, is protected by intellectual property laws. If a piece of content is not owned by floobfloob, proper credit is given where needed. Content is not used or allowed on floobfloob if it is copyrighted/owned by another Company or individual.

6.0 Limitation of Liability

To the fullest extent permitted by law, in no event shall floobfloob be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; or (iv) unauthorized access, use, or alteration of your transmissions or content.

7.0 Indemnification

You agree to indemnify floobfloob, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from: (i) your use of and access to the Services; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

8.0 Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of [Ontario/Canada, Iowa/U.S.A.], without regard to its conflict of law principles.

9.0 Terms

9.1 Changes to these Terms

Administrator(s) reserve the right to modify or replace these Terms of Service at any time. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms of Service. Your User Account or attached email will be notified about such updates.

9.2 Contact

10.0 Premium Subscriptions

10.1 Subscription Agreement

By subscribing to our premium service, you agree to pay the applicable fees and abide by these terms and conditions.

10.2 Billing and Payments

Payments are due in advance for each subscription period as specified. All payments are non-refundable. You authorize us to charge your chosen payment method for the subscription fees and any additional charges that may accrue. Note that the price may fluctuate regarding your local taxes.

10.3 Automatic Renewal

Your subscription will not automatically renew at the end of each subscription period. You will be charged the subscription fee at the current rate for the renewal term, when approved by the user. This section will only apply until a better payment system is introduced.

10.4 Cancellation

You can cancel your subscription at any time through your account settings or by contacting customer support/administrator contacts. The cancellation will be effective at the end of the current billing period. No refunds will be provided for the remaining period of your subscription.

10.5 Changes to Subscription

We [administrators/developers] reserve the right to modify subscription plans, pricing, or features, but you may not receive any notice.

10.6 Termination

We [administrators/moderators] reserve the right to terminate your subscription immediately and without notice if you breach these terms or engage in fraudulent activity. Upon termination, your access to the premium features will cease without refund.

10.7 Refunds

We do not provide refunds or credits for partially used subscription periods unless required by law. However, if there are any errors with your subscription, you may be eligible for point credit (see contact information (9.2)).

10.8 Communication

By subscribing, you consent to receive communications from us related to your subscription, including renewal notices and service announcements.

10.9 Governing Law

These terms and your subscription are governed by the laws of [Ontario/Canada, Iowa/U.S.A]. Any disputes arising from or related to your subscription will be subject to the exclusive jurisdiction of the courts in [Ontario/Canada, Iowa/U.S.A].

10.10 Credit

If there happens to be any errors with your subscription, (such as errors receiving benefits), you can contact developers/admins (see section 9.2) to report your issue and ask about eligibility for credit. Credit may include the rewarding of exclusive items or FloobFloob Poiints.

11.0 Roblox - FloobFloob Games

There are currently (and planned future) games on Roblox that are linked to your floobfloob account. Participating in these games means you are fully under the terms of Roblox.

12.0 Physical Agreements

If you wish to sign a legal agreement for these Terms, you can request one from an administrator. (see section 9.2, contact)
